How does participation in the litigation group work?

Firstly, you register on our website. This registration only takes a few minutes. After that, our processes ensure that you can participate without much effort.

Estimated expenses

The estimated total expenditure on the purchase of plant protection products during the cartel period (1 July 1998 to 30 June 2019).

Information about your company

Information about your business or agricultural company and contact information.

Conclusion of an agreement

In order to take action on your behalf and receive compensation, we will ask you to enter into a litigation funding agreement with us.

Proof of purchase

Invoices for the crop protection products purchased during the cartel period. If you no longer have these invoices, we will also accept other comparable evidence. This is necessary to calculate and enforce your compensation.

Our offer

LitFin offers affected companies a fully financed, risk-free opportunity to join a litigation group. LitFin covers all legal costs, regardless of whether the group wins or loses, and organises the entire process. There are no costs for the participating companies at any time. LitFin only receives a commission if compensation can be successfully enforced for you in or out of court.

LitFin's commission is always only a small proportion of the compensation won on your behalf. Unlike what is usual in the market, its success fee is calculated on the basis of almost the entire amount of compensation obtained for you, plus interest. There are therefore no hidden costs that are deducted in advance. Rather, the costs to be deducted are limited to the low statutory fee rates, insofar as these do not have to be paid by the other party. In the event of losing the case, LitFin will cover all costs anyway.

LitFin offers additional percentage success fees to members of cooperating associations and organisations. If you are a member of an association or federation that co-operates with LitFin, the percentage success fee for each member increases by 2%.

Do you prefer not to wait for the outcome?

LitFin will buy out your claim for up to 15% of the claim value.

LitFin offers you the opportunity to receive payment for your claim through a buy-out. As soon as we have checked your proof of purchase, we will make you an offer to purchase your claim. In this way, you do not have to wait for the outcome of the proceedings and receive payment immediately. However, the purchase amount will be significantly lower than the amount you can expect under the financing model. If you are interested in the sale of receivables, please indicate this on the registration form or contact us directly.
